Accident: 12 years after accident, dealer told to repair car | Ahmedabad News

Ahmedabad: Twelve years after Kishor Bhadani’s car met with an accident, a consumer commission has ordered Cargo Motors to repair it and make it roadworthy or pay him Rs 2 lakh as compensation. The dispute between the car owner and dealership lasted over a decade before the Consumer Dispute Redressal Commission, Ahmedabad (main) directed Cargo Motors to repair the vehicle and pay Bhadani Rs 25,000 extra towards compensation for harassment and litigation costs. According to the case details, Bhadani, a resident of Nikol, bought a car from Cargo Motors on June 3, 2011. A year later, he sent it for service and a Cargo Motors’ employee, Rakesh Patel, drove the car to the service centre from Bhadani’s residence. The car met with an accident during a test drive after being serviced. Bhadani insisted that the dealer bear the cost of repairs because the accident happened when the car was under the control of a Cargo Motors employee. Cargo Motors refused to do so, saying Bhadani had a personal relationship with Patel, who had brought the car to the service centre in his personal capacity and not as an employee. The car reached the service centre in a damaged condition and hence the dealership was not liable to bear the cost of repairs. If Bhadani wanted, he could get the vehicle repaired at the cost of the insurer or at Patel’s expense. A civil suit was filed over this dispute and Bhadani also moved the consumer commission in 2017. The commission concluded the car was damaged when it was in the dealership’s possession for service. Thus the dealer has been ordered to repair it and in case of non-compliance, to pay Rs 2 lakh to the car owner.tnn
