Dealer group Motus wins legal trademark case with Lotus

Motor Industry Legal Services (MILS) has been successful in protecting Motus Group’s trademarks and corporate identity, following Motus Group’s decision to apply for fifteen trademarks which sparked a dispute with Group Lotus.

Under section 5(2)(b) of the Trade Marks Act 1994, Lotus claimed that the trademark was unfair as the marks were only one letter different (Lotus/Motus) and that the goods and services offered were identical or similar to those provided by Lotus.

Lotus demanded the company name be changed to further differentiate the two. The dispute went to the Intellectual Property Tribunal where the case was heard on 30 August 2023.

Motus won on all counts and Group Lotus’ existing trademarks are restricted from protections against all land vehicles to motor cars only.

Lotus appealed the decision and continued with the same argument regarding potential confusion from the similar marks.

The MILS team included Paul Carroll (Solicitor), Christopher Baylis (Barrister) and Daniel Selmi (Barrister).
