Seafarers task Navy on clarity of uniforms

The Merchant Seafarers Association of Nigeria (MESAN) has said the recent public warning issued by the Nigerian Navy on wearing or appearing in naval uniforms and accoutrements lacks clarity and could infringe on individual constitutional rights.

The association’s Secretary General, Captain Alfred Oniye, said the Nigerian Navy’s warning, grounded in Chapter 12, Section 110 (1) and (2) of the Criminal Code, which makes unauthorised use of military uniforms an offence, does not provide specific descriptions of what constitutes “naval uniform” and “accoutrements.”

According to him, while the intention to preserve the integrity of the Navy’s uniforms is acknowledged, the current approach can lead to arbitrary enforcement and misuse of authority.

Oniye, a United States-trained maritime and anti-piracy security expert, said that for the law to be justly enforced, the public must be adequately informed about what exactly constitutes a violation.

He urged the Nigerian Navy to provide detailed descriptions and visual representations of their uniforms, including specifics on colours, patterns, logos, and other distinguishing features.

“It is essential to provide clear, specific descriptions of the uniforms and accoutrements to ensure the public can easily distinguish them and avoid unintentional violations,” he said. Oniye said the Nigerian Constitution guarantees personal liberty and protection from arbitrary arrest and detention (Section 35).

He warned that without clear regulations, there is a risk of arbitrary arrests, abuse of power, and potential infringement on constitutional rights. He suggested a public awareness campaign to educate citizens on these specifics to avoid unintentional violations.

Oniye also highlighted the potential legal challenges the Nigerian Navy could face if these concerns are not addressed. He said individuals who feel their rights have been violated due to vague regulations may seek redress through the courts, possibly leading to legal actions for wrongful arrest, detention, or harassment.

He said this could result in significant reputational and financial repercussions for the Navy.
