COLFAX PUBLIC SERVICE DISTRICT
Rule 19A application to increase sewer rates and charges.
PROCEDURAL ORDER
This Order requires Colfax Public Service District to give notice of the Staff-recommended rates and file proof with the Commission that proper notice has been provided.
PROCEDURAL HISTORY
On February 1, 2024, the Colfax Public Service District (the “District”) filed a Rule 19A application to increase its sewer rates and charges and for emergency interim rates.
On February 1, 2024, the Commission referred the matter to the Administrative Law Judges (“ALJ”) Division for entry of a decision on or before September 30, 2024.
On February 12, 2024, Commission Staff filed its Initial Joint Staff Memorandum, including Interim Rate Recommendation. Staff recommended the Commission approve the Staff-Recommended Interim Rates, subject to refund. Further, Staff recommended the District to publish notice of the Staff-Recommended Interim Rates.
On February 13, 2024, an Interim Recommended Decision approved Interim Rates for the District.
On March 6, 2024, the District filed an affidavit of publication attesting that customers were provided notice of the Interim Rate Increase in the Times-West Virginian in Marion County, West Virginia.
On May 30, 3024, Staff filed its Final Joint Staff Memorandum and recommended that the Staff-Recommended Rates be approved for use by the District, to be effective for all services rendered on and after the date the
order becomes final.
On May 30, 2024, a Procedural Order granted parties ten additional days in which to file a response or objection to the Staff recommendation or to request a hearing.
DISCUSSION
Pursuant to Tariff Rule 8.2.7., the District must provide notice of the recommended rates as follows:
Upon receipt of the Commission’s order requiring notice of Staffs recommended rates, the applicant shall give notice to its customers of any rate or rates so recommended within ten (IO) days of such receipt, by: (i) publishing Tariff Form No. 10 by Class I legal advertisement in a qualified newspaper published and of general circulation in each of the counties where service is provided and mailing Tariff Form No. 10 to each of its resale customers; or (ii) mailing, as a bill insert or separate mailing, Tariff Form No. 10 to each of its customers. The utility shall file a certificate of publication and mailing in the form of Tariff Form No. 6-6 with the Commission to the effect that the requirements of Tariff Rule 8.2.7. have been met.
Tariff Form No. 10, which reflects the recommended rates, is attached hereto as Appendix A.
Once notice has been provided as set forth above, a certificate of publication or mailing in the form of Tariff Form No. 6-B must be filed with the Commission. The District shall also file any publication affidavits with the Commission.
ORDER
IT IS, THEREFORE ORDERED that the Colfax Public Service District provide notice to its customers by publishing or mailing, as set forth in Tariff Rule 8.2.7, using the attached Tariff Form No. 10, and notify any resale customers as prescribed by the rule.
IT IS FURTHER ORDERED that, within thirty days of the date of this Order, the Colfax Public Service District shall file any affidavit of publication and a completed Tariff Form No. 6-B with the Commission demonstrating that the requirements of Tariff Rule 8.2.7., have been met.
IT IS FURTHER ORDERED that the Executive Secretary serve a copy of this Order on the West Virginia State Auditor’s Office pursuant to W.Va. Code Section 59-3-2(e).
IT IS FURTHER ORDERED that the Executive Secretary serve this Order upon Commission Staff by hand delivery, upon all parties of record who have filed an e- service agreement with the Commission by electronic service and upon all other parties
by U.S. First Class Mail.

TARIFF FORM NO. 10 NOTICE OF APPLICATION TO CHANGE RATES COLFAX PUBLIC SERVICE DISTRICT CASE NO. 24-0056-PSD-19A
On February 1,2024, the Colfax Public Service District filed a Rule 19A application to increase its sewer rates and charges and for emergency interim rates.
The Staff of the Public Service Commission has reviewed the application and has recommended the Staff-Recommended rates and charges. Staff-Recommended Rates generate an annual increase of $33,919 or % over the District’s current rates. The current approved rates and Staff-Recommended rates are as follows:
Anyone desiring to review the full Staff recommendation may do so on the Commission website (. ). Anyone desiring to protest the changed rates and charges must do so, in writing, within ten (io) days of the date of publication of this notice. All protests may be filed online through the Commission website using the “Submit a Comment” link or may be mailed to the Executive Secretary, Public Service Commission of West Virginia, P. 0. Box 812, Charleston, West Virginia 25323, or hand-delivered to the Public Service Commission. To help the Commission determine the justification for additional review and investigation, protests must be specific as to reasons that the changed rates and charges should be modified.
The Commission may adopt rates and charges which are the same as, greater than or less than the Staff-recommended rates and charges.
